CCD Health and Rights Task Force letter opposing Sec. 722 of the House Agriculture-FDA Appropriations Bill
We, the undersigned members of the Health and Rights Task Forces and fellow members of the Consortium for Constituents with Disabilities (CCD), are writing to you today to express strong opposition to section 722 of the Agriculture, Rural Development, Food and Drug Administration, and Related Agencies funding bill.1 This rider provision would prohibit the Food and Drug Administration (FDA) from banning devices or their use to the extent that they are authorized or ordered by a court, and thus circumvent decades of advocacy against the use of contingent electric shock on people with disabilities.

CCD and NHLP Letter To HUD
As rents soar across the country and the market becomes increasingly competitive, it is critical to keep HUD housing programs accessible to people with disabilities. The National Housing Law Project and the Consortium for Constituents with Disabilities write today to urge HUD to adopt our regulatory recommendations related to the treatment of disbursements from Special Needs Trusts (SNTs) and to illustrate how HUD’s current interpretation of its income rules is creating harmful outcomes for assisted families. HUD must amend 24 CFR Sec. 5.609(c) to clarify that disbursements of principal from SNTs are excluded from income if the source of the funds were otherwise excluded.

The RCD would impose 100% medical review by CMS contractors on every Medicare beneficiary admitted to an IRF in up to 17 states over a five-year demonstration period. The premise of this expansive audit demonstration is to help ensure that Medicare beneficiaries admitted to IRFs are appropriate patients to be served in that setting of care.

CCD Comment on TennCare II Amendment 42 Block Grant
On behalf of the Consortium for Citizens with Disabilities (CCD) Health Task Force we urge you to reject Tennessee’s proposed amendment, known as the TennCare II Demonstration Amendment 42. Tennessee’s proposal would fundamentally undermine the Tennessee’s Medicaid program by significantly reducing federal oversight and accountability for beneficiary protections. The Health Task Force opposes the conversion of the federal Medicaid program to a block grant, and we oppose the conversion of any portion of Tennessee’s TennCare program to a block grant.

During “open enrollment”, private health insurance options can be reviewed and coverage can be purchased. People with low and moderate incomes may be able to get financial help to pay for health insurance coverage. Assistance to pay for premiums and other cost-sharing may be available for individuals and families, depending on which plan is purchased.

Statement of the Consortium for Citizens with Disabilities on the Congressional Budget Office’s Score of the Better Care Reconciliation Act
Last night, the Congressional Budget Office (CBO) released a score of the Senate healthcare bill, the Better Care Reconciliation Act (BCRA). The score confirmed our worst concerns about the bill, estimating that Medicaid will be cut by $772 billion and that 15 million people will lose Medicaid coverage over the next 10 years, in addition to millions more Americans losing access to affordable and comprehensive coverage in the private markets.

Protect the ACA’s Gains for People with Disabilities
Members of the Consortium for Citizens with Disabilities strongly oppose repealing key provisions of the Affordable Care Act (ACA) without simultaneously passing a replacement plan that maintains or improves existing coverage, access, and affordability. Unfortunately, the American Health Care Act (AHCA) passed by the House would abandon or undermine key enrollee protections, and if enacted would endanger millions of people with disabilities who have gained affordable coverage and access to needed services under the ACA.

Medicaid Per Capita Caps and Block Grants: Devastating for People with Disabilities
Capping the Medicaid program would be devastating to people with disabilities. Medicaid provides health care services and long-term services and supports that maintain the health, function, independence, and well-being of 10 million enrollees with disabilities and, often, their families. For many people with disabilities, being able to access timely needed care is a life or death matter. Block grants or per capita caps place arbitrary limits on federal support for Medicaid, limits unrelated to beneficiaries’ actual health care needs.

CCD responds to American Health Care Act Manager’s Amendment
The Consortium for Citizens with Disabilities remains extremely concerned about the American Health Care Act. The Medicaid per capita caps in the original bill put home and community-based services (HCBS) for people with disabilities at serious risk of major cuts or even elimination, as the CBO noted. The recent manager’s amendment does not resolve these concerns, and in fact, likely exacerbates them.

In “Too Sick to Work, Too Soon for Medicare: The Human Cost of the Two-Year Medicare Waiting Period for Americans with Disabilities
21 people with disabilities share their experiences while waiting for Medicare after leaving work due to a variety of reasons including cancer, chronic cardiac conditions, a car accident and debilitating injuries.These real-life stories illustrate how people with disabilities waiting for Medicare struggle to pay for health care. Some pay premiums for COBRA coverage but soon find the premiums unaffordable on disability income. Others qualify for Medicaid coverage initially but lose eligibility when their disability income begins (five months after being deemed disabled by the Social Security Administration). Other people interviewed spend their savings to pay for private health insurance but quickly discover that the premiums are unaffordable or private insurers will not cover someone with a pre-existing condition.During the year-long interviewing process some of the “Too Sick to Work, Too Soon for Medicare” project participants finally get Medicare and express tremendous relief that they will at last have coverage and be able to see health care providers of their choice. Others never live to get their Medicare coverage.
