CCD Letter Opposing the EAGLES Act
The Consortium for Constituents with Disabilities (CCD) Education Task Force writes to express our opposition to the EAGLES Act (S. 391, H.R. 1229) and all federal funding supporting the implementation and use of violence risk assessment and threat assessment programs in public schools. Threat assessment programs, like many forms of “zero tolerance” school discipline, disproportionately harm students with disabilities including Black, Indigenous, People of Color (BIPOC). These systems can have severe negative consequences for students, including suspension, loss of class time, and early involvement with law enforcement.

Opposition to pending introduction of the No Kids in Cuffs Resolution, support the Keeping All Students Safe Act (KASSA)
The 68 undersigned civil, disability and human rights organizations that are national, state, and local groups advocate together to end the use of restraint and seclusion in U.S. schools. We also promote and protect the civil and human rights of Black Indigenous People of Color (BIPOC) students which includes students with disabilities, and students at the intersection of multiple marginalizations in their lives. Restraint and seclusion are traumatic and abusive practices which are disproportionately used on these children.

The COVID-19 pandemic has brought with it unprecedented challenges, particularly for students who have been historically underserved and marginalized, including the nation’s 7 million school age students with disabilities. The experience of students with disabilities has varied dramatically from district to district and state to state. For example, some students have not received the services guaranteed to them through their Individualized Education Programs (IEPs) and others have developed new and different needs as a result of the disruption the pandemic has caused.

More than seven million school-aged students, approximately 13% of the total student enrollment, are currently entitled to individualized education and related services mandated by the Individuals with Disabilities Education Act (IDEA). The CCD has advocated for many years that federal legislation is needed to establish national minimum standards to prohibit the use of seclusion and prevent the use of restraint in schools. Restraint and seclusion are dangerous practices that continue to cause children trauma, injury and death. Statement of the CCD Education Task Force Upon Release of the School Safety Commission Report
The Consortium for Citizens with Disabilities (CCD) Education Task Force is extremely disappointed in the recommendations put forward by the School Safety Commission led by Education Secretary Betsy DeVos. The report recommends withdrawing the Title VI discipline guidance which provides schools with important information to prevent discrimination. The CCD Education Task Force is pleased that the Senate is working in a bipartisan fashion to reauthorize and improve the Carl D. Perkins Career and Technical Education Act. The Career and Technical Education (CTE) program offers the potential for students with disabilities to use high school toward preparation for the workforce by encouraging specific career pathways. While there is a paucity of research on the intersection of CTE programs and disability, studies that do exist have shown that providing career preparation and transition services as early as possible has the potential to provide a pivotal platform for students with disabilities to gain access to career pathways.
